Under the Substitute Decisions Act 1992, a person can give a Power of Authority over Property which gives that authorized person to (amongst many things) to lend, sell, store or dispose of personal belongings, which includes the power to maintain or sell a house or vehicle.

Selling with a Power of Attorney for Property is a delicate issue, which requires your Lawyer to do extra due diligence and background work prior to acting to Sell the property. If a Power of Attorney is being used for your transaction, please notify our office immediately and well in advance of the closing date. Be advised that Mister Real Estate Lawyer reserves the right to refuse to act on any transaction with a Power of Attorney or if the Seller fails to disclose the Power of Attorney reasonably prior to the closing.
